Terms of Service

These Terms of Service (“Terms”) govern the use of Nivo Acquatic Control — the controller, the app, the website and the other services of the platform (together, the “Services”) — offered by Nivo Sistemas Inteligentes Ltda (CNPJ to be added), hereinafter “Nivo” or “we”. By creating an account or using the Services, you agree to these Terms.

1. Acceptance of the Terms

Using the Services means full acceptance of these Terms and of the Privacy Policy. If you do not agree, do not use the Services.

2. Who may use it

You must be at least 18 years old and have legal capacity to accept these Terms. The Services are offered for use in Brazil; use outside that territory is your responsibility.

3. Your account

You are responsible for keeping your credentials confidential and for all activity performed in your account. Notify us immediately of any unauthorised use.

4. Acceptable use

You agree not to:

• tamper with, alter or reverse-engineer the firmware or hardware in an unauthorised way;
• use the Services for unlawful purposes or in ways that compromise the security of others;
• attempt to gain improper access to systems, accounts or devices.

5. The hardware and limited warranty

The Nivo controller comes with a limited warranty against manufacturing defects, under the terms and conditions stated at the time of purchase. The warranty does not cover damage resulting from improper installation, misuse or unauthorised modification.

6. User responsibility

Nivo is an automation and convenience tool. Pool maintenance — including water quality, safety and upkeep of the equipment — remains the user’s responsibility. Automatic features (such as schedules or protections) are auxiliary and do not replace regular supervision and care.

7. Limitation of liability

To the maximum extent permitted by law, Nivo is not liable for indirect damages, loss of profits or damages arising from: internet or power outages; failure of third-party equipment; use in breach of these Terms; or events beyond our reasonable control. No automation feature should be treated as a critical safety system.

8. Service availability

We strive to keep the Services available, but they may experience interruptions for maintenance, updates or external factors. Local control via the physical buttons and the schedules stored on the device keep working even without a cloud connection.

9. Intellectual property

All software, firmware, trademarks, design and content of the Services belong to Nivo or its licensors. These Terms do not transfer any intellectual property rights to you.

10. Account termination

You may close your account at any time. We may suspend or terminate access in the event of a breach of these Terms. Termination follows the data retention and deletion described in the Privacy Policy.

11. Changes to the Terms

We may update these Terms. The date of the last update appears at the top of the document and relevant changes will be communicated through the Services. Continued use after an update represents agreement.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the consumer’s domicile are elected to settle any disputes.
